Regulatory status
Newby Dispute Resolution provides independent mediation and dispute-resolution services. It is not a regulated legal practice, does not carry out reserved legal activities and does not give legal advice. Parties are encouraged to take independent legal advice before, during and after a mediation.
Roger Newby LLM BSc (Hons) AMIMechE is registered with the Civil Mediation Council as an Associate Mediator (view the register entry) and conducts mediations in accordance with the Civil Mediation Council's Code of Conduct for mediators.
Two practices, kept apart
I mediate civil and commercial disputes only. My expert witness work is a separate practice and is not mediated. I do not act as both mediator and expert in the same dispute, nor in any matter arising from the same incident, vehicle or parties, and I will not accept a mediation appointment in a matter where I have given, or been asked to give, expert evidence. A single conflict register covering parties, insurers, solicitors, counsel and repairers is checked across both practices before every appointment. The engineering shapes the questions I ask; it does not entitle me to an opinion on the answer, and I do not offer one.
- Mediations are conducted under the Civil Mediation Council Code of Conduct.
- A complaints procedure meeting CMC minimum standards is in place.
- Professional indemnity insurance is in place; the certificate is available on request.
- Reasonable adjustments are arranged on request.
When an appointment exists
No mediation or other appointment exists, and no date is reserved, until the agreement to mediate (or other written terms) has been signed by every party and the agreed fee has cleared. Correspondence, enquiries, provisional dates and proposals do not create an appointment or any obligation on either side.
Panels and providers
Appointments are accepted directly and through mediation providers and panels, on a non-exclusive basis. Where an appointment is made through a provider, that provider's agreement to mediate, fee terms and complaints procedure govern the appointment and take precedence over the general terms on this website.
Fraud warning — bank details
Our bank details never change during an appointment. If you receive an email, message or call saying that our account details have changed, treat it as fraudulent. Do not transfer money. Contact us using the details you already hold, not those given in the message, and verify directly before sending any payment. We will never pressure you to pay urgently or to a new account.
